I fell on an icy city sidewalk and hurt my knee, but I’m not sure how badly. Should I speak to a lawyer?

Various limitation periods apply to legal actions brought in Ontario.  One of the strictest and shortest is the notice period under s. 44 of the Municipal Act.  This legislation requires that a person injured after falling on an icy sidewalk must provide written notice to the Municipality within 10 days of the fall occurring.  While there are some exceptions to this rule, it is essential that the municipality be made aware of the fall as soon as possible, including specifics of where the fall occurred.  Failure to do this can result in your claim being dismissed.

The lawyers of the Ross & McBride Personal Injury Group regularly provide this service to injured clients in the immediate aftermath of a slip and fall incident.  If you have been injured after falling on a City sidewalk, you should consult a lawyer as soon as possible to avoid your rights lapsing.
