I was injured in a car accident and I need treatment. I have an automobile policy and extended health benefits through work. I have been told I have to use my work benefits first. Is this true?

The Statutory Accident Benefits Schedule specifically states that payment of a medical, rehabilitative or attendant care benefit is not required for any portion of an expense for which payment is reasonably available under an insurance plan.

If you have access to an extended health benefit plan through work or privately, you will be required to use up those benefits first. This is a great cause of concern for many.  If you have another accident or illness and your work place or private benefits are exhausted, you may find yourself with significant out of pocket expenses for treatment and medical needs.

You should consult with an experienced personal injury lawyer who can assist you in maximizing your recovery for your accident and minimize the financial impact to you.
