Ross & McBride Achieves Justice for Dallas Based Victim of Fraudulent Mis-representation
A Legal battle which began in Texas six years’ ago ultimately was transferred to Ontario resulted in Justice for Ross & McBride LLP’s client, a Texas-based group of automotive dealerships. The Honorable Mr. Justice Ramsay of the Ontario Superior Court of Justice ruled that the Canadian corporate and personal Defendant’s must pay $216,000.00 plus judgment interest and $100,000.00 in costs to Ross & McBride LLP’s Texas-based client .
Jon-David Giacomelli and Chris MacLeod of Ross & McBride LLP’s International Legal Services Group were successful in convincing Justice Ramsay to award these damages on the basis of fraudulent misrepresentation, conversion, and unjust enrichment. In achieving this victory Giacomelli and MacLeod unraveled a carefully laid, complicated fraudulent scheme. Furthermore they convinced the Court to lift the corporate veil and to order that the individual Director and Officer of the corporate Defendant should be held personally liable. In finding for the innocent Texas victims of this fraudulent scheme Justice Ramsay made the following note:
“They were conned by two very good fraudsmen, who used all the classic tools of psychological manipulation, including sustaining an acquaintance ship where putative friendship for a number of years before springing the trap.” The judgment is presently under appeal.
